    Christine is joining us Of Counsel, after a very accomplished and impressive 20+ year career in the Plymouth County District Attorney’s office, which included her being, at various times, Chief of the District Court, Chief of the Appellate Unit, and most recently, Chief of the Superior Court and Deputy First Assistant District Attorney.     Jennifer Sheehan Moderates BBA Webinar on Insurance Coverage For Professional Liability Attorneys
    HMDRS’ Jenny Sheehan was invited to lead a seminar hosted by the Boston Bar Association discussing the recent trends in professional liability claims and important insurance coverage issues that arise in these types of claims.  As one of the firm’s “go-to” lawyers on insurance coverage issues, Jenny brought her expert insight and extensive experience in this area and was an ideal pick for the forum’s moderator.

    HMDR&S Celebrate 10 Years in Business 
    On August 1, 2011, the law firm of Hamel, Marcin, Dunn & Reardon, P.C. opened its doors for the first time.  Nearly one year later to the day, Rick Shea brought a wonderful group of lawyers to the firm with him, and Hamel, Marcin, Dunn, Reardon & Shea came together fully.  

    We celebrate these first ten years, remembering our partner and friend, Rick Shea, and looking forward excitedly towards the next decade ahead of us.  Thank you, of course, to all of our clients and friends, and also to everyone who has worked with us over the years at HMDR&S, particularly those of you on the team who have been with us from Day One: Megan Kures, Tammy Ford, Pam Johnson and Kristie Monge.  We are very lucky to work with such great people and to be blessed with such outstanding, loyal clients.

    Vincent Dunn Presents BBA Webinar Jury Selection in Practice: Tips and Strategies 
    HMDRS’ own seasoned trial attorney, Vincent P. Dunn, was recently invited by the Boston Bar Association to provide his practical insight, experience, and guidance on the jury selection process in civil cases.  Attorney Dunn was one three attorneys presenting a webinar on tips and strategies in the art of jury selection, including the particular challenges created by the COVID-19 pandemic.

    John Puleo Speaks at AACP Annual Meeting on Perfusionist Liability 
    Attorney John Puleo was invited to speak at the American Academy of Cardiac Perfusionists’ 2021 Annual Meeting.  Mr. Puleo presented on the topic “Helping Perfusionists Understand, and Avoid, Medical Malpractice Liability”.  Using national data, he was able to educate perfusionists on the common areas of exposure for their profession. Mr. Puleo also provided an overview of the life of a medical malpractice case, including an example of an actual case.

    Jenny Sheehan Presents at BBA Webinar on Fundamentals of Liability and Property Insurance
    Attorney Sheehan was invited by the Boston Bar Association to participate on a panel of attorneys discussing the “nuts and bolts” of insurance coverage.  The webinar covered the three common types of insurance policies—general liability, professional liability, and commercial property. Jenny did a great job in making a potentially inaccessible topic (commercial property insurance) interesting and extremely relevant.  During her presentation, she was able to tie the key provisions and issues in standard property insurance policies into business interruption claims that are and have been brought by restaurants during the COVID-19 pandemic.

    Megan Kures Teaches Trial Skills to New Litigation Associates at the BBA  
    Attorney Kures was asked to participate on a panel of attorneys with extensive trial practice in sharing her best trial practices and tactics with new associates.  Three panelists led a discussion hosted by the Boston Bar Association on each phase of trial.  Topics included the use of motions in limine, jury selection, opening statements, direct examination, cross-examination, experts, demonstrative tools, closing statements, jury charge/instructions, and post-trial motions.

    Richard J. Shea

    1957-2020

    It is with a heavy heart that we announce that our friend, colleague and member, Rick Shea, has passed away.  Despite his recent challenges, Rick faced life with the same happiness and optimism that was always his calling card.  He was an incredibly skilled lawyer, blessed with an encyclopedic knowledge and a voracious work ethic, and an even better individual -  a kind, generous man, who believed in family above all things.  As a leader in the Massachusetts bar for nearly 40 years, Rick was a mentor to so many, and friend to all.  We are extremely proud Rick chose to join us 8 years ago (nearly to the day). We were truly lucky to have been his friends and colleagues, and we will always benefit from our association with him.

    Kures Tackles Legal Issues in Service and Emotional Support Animal Accommodations at BBA

    On October 25, 2018, Attorney Megan Kures was invited to speak on a panel at the BBA Employment Law Conference.  The panel discussed the Cutting Edge of Accommodations covering emerging issues in employee accommodations.  Attorney Kures spoke on issues related to service animals in the workplace, including the protections offered to service animals under the ADA or MA law, the limited protections offered to emotional support animals, the lack of case law and guidance on emotional support animals in the workplace, and the factors employers should consider in making reasonable accommodation decisions.

    Megan Kures Consults on Role of Triage Tools in Med Mal Cases in ED Legal Letter

    HMDR&S Director Megan Kures was recently consulted for a medical risk management article in the November 2018 Edition of ED Legal Letter entitled Determining the Reliability of a Triage Tool in Med/Mal Litigation. Attorney Kures provided insight into the common allegations in Emergency Department malpractice cases and the role triage tools play in those case.  She acknowledged that plaintiff’s counsel could attempt to attack use of triage tools, but whether they choose to do so might depend on how strongly the ED provider relied on the tool and the provider’s testimony regarding its use.  To access this publication from ED Legal Letter, click here.

    Megan Kures Consults on Independent Contractor Status of Physicians in ED Legal Letter

    Firm Director Megan Kures was recently interviewed by ED Legal Letter for an article entitled “EP’s Independent Contractor Status Doesn’t Always Limit Hospital Malpractice Exposure” featured in its August 2018 issue.  Drawing on her years of experience in defending emergency physicians, Attorney Kures discussed the various factors that affect a plaintiff’s decision to name a hospital and the legal analysis for determining independent contractor status.  To access this publication from ED Legal Letter, click here.

    Dunn Gives Dental Ethics Continuing Education Course

    Attorney Vincent Dunn copresented an ethics course to dental providers in April 2018 through the Massachusetts Dental Society (MDS).  Vin is a regular CEU instructor for the MDS on a variety of topics including dental board representation, ethics and risk management.

    Disruptive Behavior Presentation at Mass. Eye and Ear
    Firm principals Bob Hamel and John Reardon recently lectured on Behavior In The Clinical Setting to clinicians at Mass. Eye and Ear.  The presentation addressed the professional and legal implications of unprofessional behavior on the healthcare workplace.  Administrators at MEE asked Bob and John to speak with the goal of raising the level of awareness of the types of behavior considered disruptive and the impact of disruptive behavior on the culture of respect and safety.   John and Bob were able to illustrate the clinical and personal ramifications of disruptive behavior through real life cases.

    Dunn & Bright Instruct Risk Managers on Responding to Regulatory Agency & Licensing Board Requests
    Attorneys Vincent Dunn and Toby Bright were invited to present on a challenging legal topic to the Massachusetts Society for Healthcare Risk Management at its annual educational conference.  Their presentation guided healthcare risk managers through the proper production parameters associated with requests for information from various regulatory agencies and licensing boards, highlighting areas where agencies and boards often overstep their authority.

    Mock Board of Dentistry Hearing at Yankee Dental 2018 
    HMDR&S attorneys Vincent Dunn headlined an informative and highly entertaining risk management course at the Yankee Dental Conference this year, along with the co-presenting delight of client and colleague, Deb Udey of Eastern Dentists Insurance Company.  Attorney Dunn played a competent and animated defense attorney representing a meek and misunderstood dentist. Ms. Udey played the insipid investigator for the Board.  The course presented dentists a unique view into an oftentimes opaque process.

    Attorney Reardon joined CRICO's Stephen Morey and Barbara Szeidler in presenting on malpractice risks in internal medicine to NWH's Internal Medicine Department.  The presentation included an overview of current issues, electronic health records, and informed consent practices.

    In an article recently published in ED Legal Letter by AHC Media, HMDRS’ own Megan Kures was interviewed to provide an experienced legal perspective on the issue of plaintiff's experts outside the Emergency Medicine specialty testifying as to the standard of care for Emergency Physicians.  In Some Plaintiffs’ ‘Experts’ Have Never Worked in ED, Kures provides an overview of the practice in Massachusetts and what defense attorneys can do to defend their clients' interests in these situations.  To access this

    Avoiding Legal Challenges Presentation to Residency Program Directors at Boston Medical Center
    Honesty may be a good policy when providing physicians-in-training with feedback, but not all feedback is welcomed and some can prompt adverse reactions by the recipient.  HMDR&S Principal Attorneys John Reardon and Bob Hamel recently presented to the Residency Program Directors at Boston Medical Center on the responsibilities of the reviewing physician in providing feedback to residents without prompting employment lawsuits.  In a seminar entitled “Avoiding Legal Challenges: Giving Honest Feedback to Your Resident” John and Bob were able to provide attendees with guidelines for giving feedback along with real examples of cases from their many years of experience in counseling healthcare providers and institutions in employment related matters.

    Marcin Educates MGHfC on Medicolegal Issues
    Attorney Marcin was recently invited to present on Medicolegal Issues with Dr. Vandana Madhaven, Director of Pediatrics, at the MassGeneral Hospital for Children.  The presentation provided risk management education on Medicolegal Issues to students, residents, and fellows at the Harvard teaching hospital.

    HMDR&S Opens South Shore Office!
    Hamel, Marcin, Dunn, Reardon & Shea is pleased to announce the opening of its Hingham, Massachusetts office.  In addition to its main office in Boston, as well as its Connecticut and Rhode Island locations, HMDR&S’s new Hingham location allows our firm to conveniently serve the needs of its South Shore, Southeastern Massachusetts and Cape Cod clients.  Our new office is located directly across from the Hingham Shipyard at 350 Lincoln Street, Suite 1101, Hingham, MA 02043.

    Ryan McCarthy Presents "Premise Liability: Much More than Slip and Falls" at National Ski Resorts Conference

    HMDR&S Director Ryan McCarthy gave a seminar at the National Ski Areas Association (“NSAA”) 2017 East Conference & Tradeshow at Mount Snow in Vermont at the request of client Wells Fargo/Safehold Special Risk.  Ryan, along with two other ASDA attorneys, presented to NSAA members and lead discussions on non-ski and summer related incidents resorts across the country are facing.  The presentation comes at a critical time as ski areas continue evolving into three and four season resorts, expanding their offerings and welcome a widening variety of guests.  To learn more about Ryan and his practice, click here.

  • The Supreme Judicial Court Expands the Scope of the “Mode of Operation” Approach to Premises Liability

    The Massachusetts Supreme Judicial Court (“SJC”) recently issued a decision which could potentially expand the application of the “mode of operation” theory in premises liability cases.  In Bowers v. P. Wiles, Inc.¹, SJC-11923 (July 28, 2016) (slip opinion), the SJC found that this theory applied to landscaping and similar aesthetic decisions made by a retailer regarding its retail space, and not, as has previously been the case, only in cases where the claimed injury was a direct result of a retailer’s customers being permitted to directly access the goods for sale.

  • Automated Claims Reporting and Not So ‘Best Practices’ Result in Multi-Million Dollar Judgment Against Insurer By Attorneys Matt Sweet and Jenny Sheehan
    A recent case from the Massachusetts Supreme Judicial Court may not represent a ground breaking change in insurance law, but it certainly provides some valuable lessons in best practices for claims handling. The practical result of the opinion in Boyle v. Zurich American Insurance Company, 472 Mass. 649 (2015), is that Zurich American Insurance Company was required to pay over $4 million in a case where the policy at issue had a limit of $50,000, and where there was no finding that the insurer had violated M.G.L. c. 93A.
